Terms of Service

1. Acceptance and Eligibility

1.1 Age Requirements

You must be 18 years or older to:

  • Create an account
  • Act as a Team Administrator
  • Accept these Terms

Children under 13 cannot create accounts, cannot use our service directly, and may only be listed as players by Team Administrators with parental consent.

By creating an account, you represent that you are 18+.

1.2 Team Administrator Responsibilities

If you are a Team Administrator (coach), you represent, warrant, and agree that:

Parental Consent:

  • You have obtained written or documented verbal consent from the parent/guardian of EACH player under 13 before adding them to our service
  • You maintain records of such consents
  • You provided parents with our Privacy Policy
  • Parents understand what information will be collected and how it will be used

Consent Documentation: You will maintain documentation showing the date consent was obtained, parent/guardian name and contact information, what information the parent consented to collect, and a copy of the consent form or record of verbal consent.

Immediate Removal:

  • You will remove any player immediately upon parental request
  • You will notify us within 24 hours if a parent withdraws consent
  • You understand parents can contact us directly to remove their child

Truthful Representation: All player information you enter is accurate, you have authority to act on behalf of the team/organization, and you will not add players without proper consent.

Compliance: You will comply with all applicable privacy laws including COPPA and will not use our service in any way that violates children’s privacy rights.

FAILURE TO OBTAIN PROPER PARENTAL CONSENT IS:

  • A material breach of these Terms
  • Grounds for immediate account termination
  • May result in legal liability to you personally
  • May result in fines from the FTC ($50,000+ per child)

1.3 Indemnification by Team Administrators

You (Team Administrator) agree to indemnify, defend, and hold harmless PitchKallr and Kenpar Solutions, LLC from any claims arising from your failure to obtain parental consent, any COPPA violations related to information you provided, any misrepresentation about your authority or consents, any unauthorized disclosure of children’s information, and any breach of these Terms.

This means: If you didn’t get proper parental consent and we get in trouble, you’re responsible, not us.

1.4 Parent/Guardian Consent

If you are a parent/guardian providing consent for your child to be listed in our service, you acknowledge that you’ve read our Privacy Policy, you understand we collect first name and jersey number, this information will be visible to team members, you can withdraw consent at any time, and your child will NOT have direct access to our service.

2. Account Creation and Use

2.1 Account Registration

To create an account: provide accurate information (name, email, password), you must be 18 or older, one account per person, no sharing accounts.

2.2 Account Security

You are responsible for keeping your password secure, all activity under your account, notifying us of unauthorized access, and logging out when finished.

We recommend enabling two-factor authentication when available, especially for Team Admins.

3. Player Information and Privacy

3.1 What You Can Enter

Team Administrators may enter: player first names (no last names), jersey/position numbers, team assignment, and game participation and pitch data.

Team Administrators may NOT enter: last names, email addresses or phone numbers, home addresses, birthdates, photos or videos, social security numbers, or any sensitive personal information.

Violation = immediate account termination.

3.2 Data Ownership and Control

Who owns the data: Parents own their child’s information. Team Admins have a temporary license to use it for team management. We (the service) are processors, not owners.

What happens when you delete: Team Admin deletes player — removed within 24 hours. Parent requests deletion — removed within 10 business days. Account deleted — all data deleted within 30 days.

3.3 Privacy Settings

Team Admins can set team privacy to Private (only coaches see player info, the default), Team-Only (team members see roster), or Organization (league members see roster).

4. Prohibited Uses

You may NOT:

  • Add players under 13 without parental consent
  • Share login credentials with minors
  • Enter false information about children
  • Use service to collect data for other purposes
  • Scrape or export data for external use
  • Share player information outside the platform
  • Use service in violation of COPPA or other laws
  • Attempt to re-identify anonymized data

Violation may result in immediate account termination, legal action, and reporting to authorities.

5. Our Rights and Obligations

We may: terminate accounts for violations, remove violating content, investigate suspected COPPA violations, report violations to authorities, and modify service features (with notice).

We will: protect player information with reasonable security, respond to parent requests within 10 business days, delete data when requested, notify of breaches within 72 hours, and comply with COPPA and applicable laws.

6. Limitation of Liability

We are NOT liable for: Team Administrator’s failure to obtain parental consent, misuse of service by Team Administrators, data breaches caused by Team Admin negligence, disputes between parents and coaches, or inaccurate information entered by Team Admins.

We ARE liable for: our own negligence in protecting data, breaches caused by our security failures, and violations of our own policies.

We provide service “AS IS” without warranties. We guarantee good faith efforts to protect data, compliance with COPPA requirements, and prompt response to security issues.

7. Term and Termination

Team Admins: Go to Settings → Account → Delete Account. All team data deleted within 30 days.

Parents (to remove child only): Contact your Team Admin, or email support@kenparsolutions.com.

We may terminate: immediately for Terms violations, with 30 days notice for convenience, or immediately for COPPA violations.

8. Dispute Resolution

Informal Resolution First: Contact us at support@kenparsolutions.com. We’ll work with you for 60 days to resolve.

Arbitration: Most disputes go to arbitration, not court. Exceptions: COPPA-related claims by parents, small claims court (under $10,000), and injunctive relief requests.

COPPA Exception: Parents may opt out of arbitration for any claims related to unauthorized collection of their child’s information.

Class Action Waiver: You agree not to participate in class actions against us. This waiver does not apply to COPPA claims.

9. Miscellaneous

  • Modifications: 30 days notice for material changes; immediate effect for minor changes
  • Entire Agreement: These Terms + Privacy Policy = entire agreement
  • Severability: If any provision is invalid, the rest still applies
  • No Waiver: Our failure to enforce doesn’t waive our rights
  • Assignment: You can’t transfer your account; we can transfer our obligations (with notice)
  • Governing Law: Governed by laws of Texas, USA
